The Real Estate Landscape Just Shifted—Here’s What You Need to Know

The real estate industry is going through a major transition, and if you're thinking about buying or selling, it's more important than ever to understand what's changing and how it affects you.

This shift comes in response to a recent legal settlement involving the National Association of Realtors (NAR), and it’s reshaping how real estate commissions are handled, how buyer representation works, and what agents need to disclose.

What’s Actually Changing?

Here are three key takeaways from the NAR settlement:

1. Commission Transparency is Now Mandatory
Going forward, agents must clearly explain who pays what—no more confusion about how commissions are split between buyer and seller agents.

2. Buyers Will Sign Agreements Up Front
If you’re buying, expect to sign a buyer agreement before touring homes. This protects everyone and makes sure expectations are clear from the beginning.

3. Commission Offers Are No Longer on the MLS
Seller agents can’t post commission incentives to buyer agents on the MLS. This means buyer compensation will be handled more directly and intentionally.


What This Means for Buyers and Sellers

For Buyers:
You’ll now have a formal agreement with your agent, which ensures you’re represented and that their compensation is clearly spelled out. This might sound like a hassle, but it actually gives you more clarity and control.

For Sellers:
You’ll decide upfront whether to offer compensation to the buyer’s agent—and how much. This becomes part of your pricing and negotiation strategy, rather than something hidden in the fine print.
